How to look intelligent while discussing any topic of law. A practical tip.

Standard

To improve your expressions in courts, you need to rehearse the way you express your thoughts. One easiest way to do this is to discuss topics of law with your friends on tables of the library or in the tea canteen.

When you are discussing a current law topic with your friends in Bar, try to discuss a pattern instead of discussing a stand alone incident.

Here is an example :

Instead of discussing Hajib Row Verdict by Karnataka High Court, as a stand alone judgement, try to discuss a whole pattern from Sabrimala Temple Judgement of Supreme Court to Hijab Row Verdict.

Discuss what Justice R. F. Nariman has said in the Sabrimala Case.

Then discuss what Justice Indu Malhotra has said in that judgement. Discuss why did she give a dissenting opinion. What did she say.

Then discuss similar judgements discussed in this Hijab Row Verdict.

And above all, do not express your own  personal views during the debate. Discuss what judges have discussed. Reserve your personal opinion for the time being. Do not express your personal opinions unless you are called upon to express your personal views. And then also reveal your personal views with disclaimer that your view is not final and you are open to change your view if you come across a more rational view.

Do not let other think that you are biased in favour of one or another view.

Because, here, in this place, your only and only aim to sharpen your own debating skill.

Just argue plus and minus points of arguments of each judge.

Now you cannot debate in above way unless you have read those judgements.

So you need to read those judgements, one day earlier, in order to debate immpressivly.

In Bar Room Tea Clubs, if you see that on some table some senior advocates are debating some issue, you may find that they are discussing similar to the ways pointed out by me above.

If you want to become a Fighter Lawyer, it is okay, it is your choice. But if you aspire to be a judge, then you have to mind every…..

Standard

Being a fighter lawyer has its own advantages and disadvantages. You are like a free bird flying in the open sky at your own risks and costs.

But if you aspire to be selected as a Judge, then you have to mind every word you speak or write.

There are highly sophisticated databases and search tools with which the government as well as non government agencies, can look into your mind to identify your line of thinking.

If you speak or write a word against any ruling party or its leader, then obviously you may suffer a roadblock when you may be being considered for judgeship.

If you speak or write a word in favour of the ruling party or its leaders, then also you may suffer a roadblock. Opposition can question your suitability for judgeship.

Try to mind every word you speak or write. Speak innocent words. No one should be able to use your words against you.

Also mind what you are scrolling on social media. Every time you scroll a post, you leave digital fingerprints. The digital records of posts you have scrolled can also disclose your line of thinking.

These cautions are necessary if you are aspiring for judgeship.

I have written this post in hope that this post may give some food for thoughts to young lawyers who are aspiring to be a judge.
